GICJ repeats its Condemnation to Israel's Annexation Threat 

On Al-Naksa Day

 The 5th June 2020 marks the commemoration of the 53rdanniversary ofNaksa. In light of Israel’s recent threats to illegally annex the occupied West Bank, the commemoration must draw the attention of states to the need for urgent action to do all that is necessary to prevent the illegal annexation. States must speak with a strong and clear voice in condemning these deplorable threats and preventing Israel from following through with its planned illegal annexation. The annexation is scheduled to take effect next month.

Geneva International Centre for Justice (GICJ) adds its voice to the strong condemnation of Israel’s threats and calls on the United Nations to ensure that the illegal annexation does not take place. 

At the end of the 1967 Six-Day War, Israel delivered “Naksa” to the Palestinians. The Arabic word “Naksa” meant defeat and led to tens of thousands of Palestinians being forcibly displaced from the occupied Palestinian Territory (OPT) as Israel took control of the West Bank, Gaza Strip, Egypt’s Sinai Peninsula and Syria’s Golan Heights. Prior to this,  as Israel was establish in 1948, an extremely violent war followed and propelled the ethnic cleansing of Palestinians through their systematic expulsion from their homelands.

Israel’s illegal annexation has been systematically strategized and implemented gradually for decades as evident from the prevalence of illegal Israeli settlements in the OPT which has consistently grown over the years. In parallel, Israel has systematically disempowered Palestinians in the OPT. Palestinians are denied construction permits and prevented from constructing schools, hospitals and homes.

 Palestinians’movements are regulated and impeded throughroad blocks and checkpoints, which are set up on a daily basis. Israeli policies have rendered it near impossible for Palestinians to seek vital medical care which has had dire consequences, especially during the current pandemic.

These Israeli policies are blatantly discriminatory as they only apply to Palestinians and not to Israeli settlers ortheir settlements. Settlersare able to benefit from government aid, including the financing of housing, education, and infrastructure. Settlers are placed under Israeli civil law whereas Palestinians are judged according to Israeli military law. Israel has implemented a modern day apartheid system, in gross violation of international law.

Under the Fourth Geneva Convention, the transfer of civilians of the occupying power into the occupied territory is prohibited and yet, in the OPT, Israel is doing so deliberately and systematically. This is a flagrant breach of international humanitarian law and continues despite numerous UN resolutions demanding Israel’s withdrawal from the OPT.

Israel continues its illegal occupation of the Palestinian territory and currently occupies 85% of Palestine with the remaining15% left for Palestinians, although majority of these lands remain subject to some form of Israeli control.

GICJ urges the international community to take immediate action against Israel’s continued and ongoing violation of the human rights of Palestinians in the OPT. Palestinians are at greater risk due to Israel’s threats of illegal annexation and they need the international community to act urgently and decisively. The international community must ensure therights of Palestinians to self-determination now as, despite numerous UN resolutions declaring that right, it has yet to be realised.

GICJ calls the international community to hold Israel accountable for its war crimes which have been many and recurring in OPT for decades. The impunity which Israel has enjoyed has led to the current state of affairs, where they are now able to issue threats of illegal annexation without fear of consequence. If ever there is to be a transition to justice, it must be now as justice for the Palestinians is long overdue

GICJ expresa nuevamente su condena a la amenaza de anexión por parte Israel

 

El 5 de junio de 2020 se conmemora el aniversario número 53 de Naksa. Debido a las recientes amenazas de Israel de anexar ilegalmente la Ribera Occidental ocupada, la conmemoración debe traer a la atención de los estados la necesidad de adoptar medidas urgentes para hacer todo lo necesario para impedir la anexión ilegal. Los estados deben hablar con una voz firme y clara al condenar estas deplorables amenazas y prevenir que Israel siga adelante con su anexión ilegal planeada de antemano. Está previsto que la anexión entrara en vigor el mes próximo.

El Centro Internacional de Ginebra para la Justicia (GICJ) suma su voz a la firme condena de las amenazas de Israel y pide a las Naciones Unidas que se aseguren de que la anexión ilegal no se lleve a cabo.

Al final de la Guerra de los Seis Días de 1967, Israel entregó "Naksa" a la gente palestinia. La palabra árabe "Naksa" significa derrota y provocó el desplazamiento forzado de decenas de miles de palestinos del territorio palestino ocupado (TPO) cuando Israel asumió el control de la Ribera Occidental, la Franja de Gaza, la Península del Sinaí en Egipto y los Altos del Golán de Siria. Antes de esto, cuando se estableció Israel en 1948, se produjo una guerra extremadamente violenta que indujo la limpieza étnica de los palestinos mediante la expulsión sistemática de sus tierras natales.

La anexión ilegal de Israel ha sido objeto de una estrategia sistemática y se ha aplicado gradualmente por decadas, como lo demuestra la prevalencia de los asentamientos israelíes ilegales en el territorio palestino ocupado, que ha ido aumentando constantemente a lo largo de los años. Paralelamente, Israel ha denigrado sistemáticamente a la gente palestina en el territorio palestino ocupado. A los palestinos se les niegan los permisos de construcción y se les impide construir escuelas, hospitales y viviendas.

La circulación de los palestinos está regulada y obstaculizada a través de bloqueos de carreteras y puestos de control, que se establecen diariamente. Los estatutos israelíes han hecho casi imposible que los palestinos recibanla necesaria atención médica, lo que ha tenido consecuencias nefastas, especialmente durante la pandemia actual.

Estas políticas israelíes son claramente discriminatorias, ya que sólo se aplican a los palestinos y no a los israelíes o a sus asentamientos. Los colonos pueden beneficiarse de la ayuda del gobierno, incluida la financiación de la vivienda, la educación y la infraestructura. Los colonos se someten al derecho civil israelí mientras que los palestinos son juzgados según el derecho militar israelí. Israel ha puesto en práctica un sistema de apartheid moderno, en flagrante violación del derecho internacional.

Bajo el Cuarto Convenio de Ginebra, se prohíbe el traslado de civiles de la potencia ocupante al territorio ocupado y, sin embargo, en el territorio palestino ocupado, Israel lo hace de manera deliberada y sistemática. Se trata de una violación flagrante del derecho internacional humanitario y continúa a pesar de las numerosas resoluciones de las Naciones Unidas que exigen la retirada de Israel del territorio palestino ocupado.

Israel continúa su ocupación ilegal del territorio palestino y actualmente ocupa el 85% de Palestina, dejando el 15% restante para los palestinos, aunque la mayoría de estas tierras igual están sujetas a alguna forma de control israelí.

El GICJ insta a la comunidad internacional a que adopte medidas inmediatas contra la continua y permanente violación por parte de Israel de los derechos humanos de los palestinos en el territorio palestino ocupado. Los palestinos corren un mayor riesgo debido a las amenazas de anexión ilegal por parte de Israel y necesitan que la comunidad internacional actúe decisivamente y con urgencia. La comunidad internacional debe garantizar los derechos de los palestinos a la libre determinación ya que, a pesar de las numerosas resoluciones de las Naciones Unidas que declaran ese derecho, todavía no se ha hecho realidad.

El GICJ pide a la comunidad internacional que haga a Israel rendir cuentas de sus crímenes de guerra, que han sido numerosos y recurrentes en los TPO durante décadas. La impunidad de la que ha disfrutado Israel es lo que ha llevado a la situación actual, en la quepueden emitir amenazas de anexión ilegal sin temor a las consecuencias. Si queremos llegar a una transición a la justicia, debe ser ahora, ya que la necesidad de justicia para los palestinos a estado pendiente ya muchísimas décadas.
